Legal Question in Wills and Trusts in Illinois

Is an Ilinois will ''ruled from the grave?''

My grandfather died almost 60 years ago. He left a trust for my mother which pays her $100 per month. Can this be altered to reflect his intent (enough to live comfortably) or must it be left as is? The trust is now well over one million and she is 77.

The answer depends upon the language of the trust agreement. Often the trustee has the power to make greater distributions of income or principal under certain circumstances. Check with the attorney for the trust or the trustee himself, or read the trust agreement yourself to see what remedies may be in it.
