Wills involving minors

My ex-husband passed away leaving our 10 year old son major benefactor of his will. I am his mother and legal guardian, can the will be read without my presence?

Hello. The will may be read out of your presence,

however you have a right to receive any and all

court notices on behalf of your son. In fact,

you need to open upon a guardianship for your son

so that when the money from his dad's estate is

distributed, a minor's estate with you as guardian

will already be set up. I will be happy to answer
