Legal Question in Workers Comp in Illinois

no w/c benefits piad been off work for 5 weeks

i have been off work for 5 weeks i was injured 1 year ago w/c have been paying for every thing been on light duty all this time i have seen my drs and 1 ime dr they all say i need spinal fusion i havenot been payed any thing ever iam scared i will lose my hose i have an lawer he does noting please advise

You need to have a conference with your current lawyer. He/She should be willing and able to explain where you are at and where you are likely to go with your case. Also, make sure your attorney really knows the Work Comp area. If you are not satisfied with the answers you get or those answers are vague and slow to come, then you should consider consulting another attorney for a second opinion.

You have the right to change attorneys. But do so carefully. Beware of the attorney who promises a landmark result.

ANSWER:

Sometimes lawyers have too much time to explain to you all of the work that they are doing on your behalf...

Other times, lawyers have too much work or not enough experience to know what to do...

In your case, you need to call your lawyer and see him immediately for a one-on-one consultation. You need to communicate your concerns and he needs to explain his legal strategy/plan.

If he (or she) will not, or cannot, do that tomorrow or the next day then you need to hire a new lawyer - which is very easy to do in workers' compensation.

You have several choices:

1- talk to your lawyer and see why things are taking so long.

2- talk to another lawyer who then can review what your lawyer has done so far and advise you as to whether or not you are on the right track.

3- fire your current lawyer and hire another.

From what you say, you have a good case and you deserve proper representation and compensation. Whether or not your current lawyer has done everything that needs to be done, is something that must be reviewed.
