Legal Question in Business Law in India

An Australian based company vide Power of Attorney authorized Mr. XYZ of Assam, India to execute certain works in the State of Arunachal Pradesh. The said POA was notarized before the Notary Public, Melbourne and also notarized at Guwahati. In this regard Mr. XYZ has also sworn an Affidavit before the Notary, Guwahati. Now the question comes, can this POA can be accepted as a valid documents or the same is required to be authenticated before the Indian Embassy at Melbourne, if yes under what provision? Your immeidate reply specifying the same clearly is highly solicited.Please also indicate the provision in your suitable Answer.

if the document has been properly notarised in australia then it is a valid document. you just need to see that the proper stamp duty has been paid. you can see notary act and transfer of property act.

No the POA is not a valid document it should have been attested by Indian High commission.
