Dear Sir,

I have a sale agreement of Property with term and condition sale agreement Dated 10/01/2013 i take Token Money Rs 35000/- and its mention clearly in agreement if buyer not give rest amount Before date 26/02/2013. token amount surrender in my custody and agreement cancel. and on date 26/02/2013 i go sub registrar office take my attendance Receipt other party note come in last date... but after one day he call me and said to me i cant pay you rest amount and give my money back other wise i go to court ... please answer me what i do?

You are legally entitled to refuse to pay back, but you will be faced with litigation, so it is your choice and discretion, as to refund the amount or not, and if you choose to refund, how much to refund.

Practically advisable to refund.
