Legal Question in Criminal Law in India

I Have filed a case under Section 9 on dated 28.08.12 and my wife filed a case under Section 125 Cr. PC on dated 21.11.12. So can i able to avoid maintenance? She alleged in her petition that her and baby's life is in danger to live with me. Everybody knows that she lying. She was also teaching in a private school and earning Rs. 6000/- per month i have the proof. She is demanding a house at New Delhi or her domesticity. I have also many of witness for the same. I am fearing that she will not give me my baby. I want may baby.

Hello,

Maintenance is a complex issue. It depends upon many circumstances. Mere salary of Rs 6000/- is not sufficient evidence for avoiding a property transaction. She can anyway claim property depending upon the status of husband.

Maintenance also depends upon the status of her living and her husbands status and resourcefulness.

You are liable to give kids maintenance and future expenses.

If, you want your kid, file a custody matter asap.

maintenance is very complicated issue, all the maintenance are depend upon the circumstances and the status of the party,you have to give details for final opinion apparently it can say that if u prove ur case then the will take lenient view regarding your matter.
