Legal Question in Family Law in India

Sir,

I am married for 1 year ,my in laws and husband harassed me mentally ,harassed and insulted iin public me and my parents for more dowry ,my in laws were very possesive of their son and not even letting him to spend anything for me.We used to stay in US and there he used to harass me like leaving me in unknown place , calling cops thrice for divorce ,everything created lot of stress, i used to bear all this for sake of my parents reputation and respect in society ...but all this stress resulted in lot of health problems, which made me weak ..he just made me to stay only at home and i was dependent and took all the money from me , finally one day i decided to escape and came to India . I was patient when i came to India ,now am recovering slowly .My elders and mediators told me to be calm for 4 months and recover from health issues and then they will be solving this issue , my parents and family never involved in any sort of quarells n divorce.they are scared of these...i am worried whats the time i need to file case ??in what way i can get justice??? if i delay to file case is it going to benifit my husband and his family??? i lost my career,health and money...it was love for more than 2 years then he married then i realised it was all for money he trapped me

You file a case for divorce and maintenance. You can get justice and there is no delay.

You can postpone filing divorce petition, but you don't make delay in lodging complaint and filing domestic violence case. It is better to file these ASAP. However, if you file case for divorce, it will be benefitting your hubby rather than you. It will be rather welcomed by him if you yourself seek divorce.
