Legal Question in Employment Law in India

Sir, We are the employees of Indian Oil Corporation limited (an PSU). We do our duty in rotating shifts and covered under The Factory Act. In the year 2010 we did some overtimes at the end of the year. But our Management refused to pay the overtimes showing the reason of excess overtime consumption in that year and promised verbally to pay the overtimes in the next year. But still now our Management didn't pay it. Our recognised union raised dispute before Regional Labour Commissioner(C). But still now the dispute was not settled and RLC(C) is taking times. So we are still remained unpaid. Sir, can we take some legal activities against our Management? If yes, how & which ground?

Regards,

MALAY

Try to expedite the matter before RLC, move an application of early disposal. If not then you can move to the labour court for necessary directions or a writ petition before the high court..
