दिल्ली में grandfather के नाम एक प्लाट है उसका बटवारा नहीं हुआ है लेकिन मेरा भाई उस प्लाट पर मकान बना रहा है और निर्माण कार्य शुरू कर चूका है. में इस प्लाट पर stay आर्डर लेना चाहता हु. कृपया मुझे बताये की stay आर्डर लेने के लिए कोर्ट में केस डालना जरूरी होता है या दिन केस डाले ही stay आर्डर लिया जा सकता है

Is your Grand father alive ? If he is alive then you have no right or share in his property to file any case to get a stay order from the court. Please clarify.

Dear Sir / Madam,

You may first ascertain the facts whether your grandfather has actually already transferred his ownership in the plot of land to your brother, and apparently verify the supporting documentary evidence thereon to check whether the same is in order.

Just abruptly going ahead and asking the Court to grant a stay-order may do you no good, especially if the above documentation executed by your grandfather is in proper order, with the ownership being transferred in the name of your brother.

A stay order is passed by the concerned Court based on an application thereof filed by the aggrieved party.
