Legal Question in Real Estate Law in India

Sir, I want ask a question regarding partition of property.

Mere father ke naam ek house hai wo expire ho gaye hai aur unhone koi will nahi ki hai. Ab me us house par partition ka case daalna chahta hu. Mere chote bhai ne us house par Charitable trust banakar Board lagaya hai. Kya us board ka partition ke case par koi asar padega? Please guide.

dear Mr Rakesh

the property belongs to the legal heirs if the father has died without a will I.e. intestate.

so your brother cannot transfer the property to a trust.

you have to move to court to get your share of property.
