Legal Question in Wills and Trusts in India

i accepted a token amount in cheque from the buyer of my flat.on very next day he paid the stamp duty of my flat without any copy of documents and agreement.on the same day i deposited that cheque.due to a sudden personal problem i decided to cancel the deal on the forth day..when i offered him the token money cheque he refused. he threatens me to sue. all that he has is the reciept of token signed by me. I am worried what he would do.. he asked double the token amount only on the third day ..

All depends on the agreement you executed along with receiving token amount. He has a right to sue you fro specific performance. You ought to show the agreement to a lawyer, only thereafter you can be guided properly.

Dear Friend,

Your only option, if in case the buyer is willing to show leniency towards you, is to quietly offer the buyer the full refund of the token amount and the stamp duty amount paid by him / her for purchase of your flat in Goregaon (East), Mumbai without any "panga".

You are left with no other choice.

Regards,
