Legal Question in Bankruptcy in Indiana

Do I have to Pay My Dad's Bankruptcy Lawyer Bill?

Hi, My Dad had to file Bk and is having problems paying his lawyer bill. His lawyer is now going after me (daughter) to pay the bill. He is saying I lived in my Dad's rental rent free and therefore I have to pay the lawyer unpaid rent to my Dad. My Dad had a home that I did stay in during the bk process. Does this lawyer have the right to take me to court? My Dad is willing to pay but its just taking him awhile to pay it. Any helpful input appreciated!

As I understand the situation, you do not have to pay the legal fees. In fact, if your father has already filed bankruptcy, he may not need to pay the legal fees either. Any unsecured debt he owed at the time he filed bankruptcy, including any legal fees, were (or will be) discharged in the bankruptcy (with a few exceptions -- and those exceptions do not include legal fees).
