Legal Question in DUI Law in Indiana

Minimum Sentence for 4 DUI's since 1994

I am caring for my grandson as his mother has recently received her 4th dui (the latest while on probation for a previous dui) recent incarceration for failing mandatory breathalisor(sp) test while awaiting trial for last arrest. She has a total of 4 dui arrests since 1994. With a good lawyer can she avoid a mandatory jail sentence with time served? Will she lose her driver's license for 10 years even with a good attorney?

We are trying to make decisions regarding my grandsons living arrangements and education, any information will be appreciated.

Thank you

Re: Minimum Sentence for 4 DUI's since 1994

Your daughter has a serious situation which will require a great deal of attention. The prior DWI's will not help and if she has a prior felony conviction she may not be suspendable. Yet, without knowing all the facts and whether she may be able to ask for AMS it is hard to say.

Should you and she wish to to look at this further, you may contact me at 686-0000. If I have a better overview of the situation I will be able to give you a better one.
