Legal Question in Family Law in Indiana

military deployment and visitation

Is my wife (daughters step mother) still allowed to enforce parenting time whiel I am on military deployment? I am leaving for training soon and am being told by the custodial parent that my wife has no rights to see my daughter. Is there somethign I can file pro-se to have this changed and where could I get the forms?

Re: military deployment and visitation

I am unaware of any case law that is directly on point, although there is case law that allows a stepparent who was the spouse of the custodial parent to have parenting time rights. However, in that instance the court based part of its decision on the fact that the stepparent had been involved in a custodial type relationship. Your situation is far too complex for forms. Unfortunately, you really need to see an attorney.
