show of cause

i live in ohio and my kids live in indiana and my ex husband has served me with papers to show cause why i am behind in child support - but i am paying just not the full ammount and i am rep myself and would like to know what papers to file in responce to this which i will send to the court along with copies to his attorney.. I need to know what forms.. Please Advise

You need to get a record of all of your payments. If your financial situation has changed you can go to the Indiana Judiciary Web Site and obtain a form for filing a petition to modify child support. You will need to show your present income and request income information from the custodial parent and then use the child support calculator at the website to determine what child support should be.

The problem that you have, is that modification is not retroactive, so you will not be able to make the adjusted amount back to the time that your income changed.

The impression that I get is that you do not intend to appear in person for the hearing. If my impression is correct, you may be making a big mistake. You need to be there to show the court that you have been making payments, just the correct amount and explain why. Good luck.

Go to www.indygov.org/cgi-bin/courts/support.cgi

and you can figure out what you should be paying in child support. If your income has changed, then you can file for a modification of child support.

You need to figure out what your -x- is making as well and the amount of nights that is spent at each home to accurately figure the child support sheet. If you'd like more information, go to our website and click family law- it will give you more information.
