Legal Question in Family Law in Indiana

My son is going through a divorce and asking for a 50/50 arrangement for child legal and physical custody of his son. The wife has been convicted twice for child endangerment against the child (separate states); arrested and jailed for spousal abuse and child neglect; investigated by children's services in three states for child neglect; has left the child twice in the care of someone who was either unwilling or unable to properly care for the child, where the caregiver was arrested for child neglect. Does this situation fit Indiana's description of an unfit parent?

It doesn't really matter whether it fits a description or not. These are facts that could support your son's case should he seek primary custody of his son; why he is only asking for a 50/50 arrangement is not explained here. He needs to talk to his attorney about these things, and the best thing you can do is help him hire one of he does not have one already.
