Legal Question in Real Estate Law in Indiana

My sister inherited our family farm.. she then married a very deceptive man whose name she had legally put on the title to the property. He then without her knowledge mortgaged the house and then took out another loan against the property and illegally forged her initials. When they were divorced the court ordered him to turn all mortgage information over to her and ordered her to pay the mortgage payments which she has done. This man has not ever given up the papers to the mortgage which keeps getting sold to other banks and the banks will not communicate with her. This man is supposedly in 3rd state kidney failure. My sister has been told, not by an attorney that his accounts would be frozen and she would have to sell the house or have it refinanced when he dies which she cannot afford and she does not want to sell our family home. This man has committed fraud, disobeyed a court order and has committed bankruptcy in my sisters name without her knowledge.. Please! How can we get help to make this man turn over the mortgage papers and sign everything back into her name? He refuses and we have no money for an attorney!

Three is no way to handle this without an attorney, and the only way SHE will be able to straighten this out is if SHE hires an attorney. If the family farm has value, this is what she will do. If you need a copy of the mortgage, she can go to the courthouse and get one. An attorney is really the only answer, not trying to get advice on this forum; there is too much an attorney needs to know to provide any answers, and then too much advice to give.
