You have two years from date of incident to file a formal complaint in workmen's comp. for any benefits---otherwise you are forever barred. As for the timing of your surgery, that is directed by your employer's insurance company and you have to comply with the treatment that they direct. You can ask them for a delay, but they don't have to give it to you.
