Legal Question in Family Law in Iowa

currently in divorce proceedings and he wants to write into the divorce that i am required to pay a portion of his credit card debt that he incurred before were were married. This debt is lawyer bills that he choose to pay to help me at that time. He paid these bills in Aug 2012 with credit cards that are in his name only and were were married in Nov 2012. Can he do this?

Why would you agree to this? You are not accountable for any bills that he incurred before marriage. See, Iowa Code 597.17

597.17 LIABILITY FOR SEPARATE DEBTS.

Neither husband nor wife is liable for the debts or liabilities of

the other incurred before marriage, and, except as herein otherwise

declared, they are not liable for the debts of each other contracted

after marriage; nor are the wages, earnings, or property of either,

nor is the rent or income of the property of either, liable for the

separate debts of the other.
