Legal Question in Insurance Law in Iowa

My parked car hit by stolen vehicle

My car was legally parked at a park and ride and I returned to find it totaled. We found the suspect vehicle and it was reported stolen shortly before it hit my car. Who do I go after for damages? Can I go after the owner of the vehicle that had hit mine? I only had liability insurance.

Re: My parked car hit by stolen vehicle

I've answered this question previously on my website. In Iowa the owner is liable for negligence of drivers the owner grants permission to use the vehicle. In this instance if the car was stolen, and I'm doubtful of that without knowing more, then you would not be able to collect from the owner. Was the other car insured? My guess is it was not; knowing the car was uninsured the permissive driver notified the owner of the accident and they immediately phoned it in as stolen. I don't know this to be the case but it's certainly a possible scenerio. Do some followup with the police. What time was the stolen vehicle report filed? By whom? What was said? Photograph the "stolen vehicle". Does it appear credible? What is in the car? From where was it stolen? When? Who had possession of it just before it was stolen? Etc...
