Legal Question in Legal Ethics in Iowa

Employer did not pay insurance and I just found out it has been terminated.

My mother died of cancer on Thanksgiving morning

(11/28/02). She had been making insurance payments

to her employer who was in turn to pay the insurance

company. Just 3 weeks ago I found he had not done

this since August of 2002. Even though mom paid her

payments to him, he terminated with the insurance

company for non-payment and kept my mothers money.

We have proof of this. We are finding multiple

thousands of dollars in health care bills which the

hospital and doctors say mom's estate is responsible

for. On top of this, the insurance company just sent the

termination letter dated 11/27/02...it came in the mail

01/03/02. They had approved EVERYTHING til the end.

They claim it takes a while to update records. I don't

believe a good business should take this long to do

their job.

Not once were we notified by the employer or the

insurance company until the insurance co. letter came

last week.

I need to know what our (mom's estate) legal rights are

and what can be done about this situation.

It sounds as though the estate has a legal claim against the employer for the expenses incurred as a result of the employer's fraud. Consult a general practitioner in your town. Your local bar association will recommend one if you need them to.
