Demotion after returning from Maternity Leave

I was demoted after returning from Maternity Leave. I assigned an attorney in May of last year. My ex-employer hired an attorney, who happens to be my attorney's landlord. They are in the same building, 3 offices down in the same firm, but are not practicing out of the same firm. My attorney rents the office from my ex-employers attorney. I do not feel my attorney is doing anything and keeps blowing me off. I also feel there is a conflict of interest. How can I get rid of my attorney without him putting a lien on the case?

Personally, I am very skeptical about attorney liens. However, if you believe that your attorney has a conflict of interest and you want to terminate his services, you should advise him so and advise him that he cannot expect any payment under the circumstances (since he does have a conflict)and request an express release of a lien if he has one. If he is unwilling to agree to this, you should consider filing a complaint with the ethics committee. Part of the answer might turn on how much work the attorney has done. It is not absolutely clear that the attorney has a conflict simply because he is a lessee of the employer's attorney--but possible. The bigger issue seems to be whether he is doing the work you expect.
