Legal Question in Criminal Law in Kansas

Type Your Question Here... My 15 yr old daughter was caught shoplifting. This is the first time she has ever been in trouble. The friend she was with also got caught however it was her friends 2nd offense. My daughter had 1 item in her purse,which was a package of fake fingernails, and her friend had 2 items that were in her boots. Since it was her friends 2nd offense they are pressing charges against both. Both girls were handcuffed but weren't read their rights and the paper givin to me said they were arrested. The item she took was under $5.00 but they told me it was $19.00 worth....they even showed me the item my daughter took. What are my daughters rights?

You were wise to seek counsel. However, you need to get an attorney fior your daughter, that can advise you both regarding the specific facts of her case. People often assume that not Benny given the Miranda reading of the rights, means one cannot be convicted. It only means that a confession (or some statements) may not be admissible against them at trial. Inner can still be convicted without a confession. Getting her an attorney, may allow her to avoid a criminal record.
