Legal Question in Elder Law in Kansas

When your elderly parent cannot care for themself

I would like to know what I need to do to place my elderly parent in a nursing home? He is 73 yrs old, a veteran, and is an alcoholic. I believe that he may have some brain damage from drinking for so long. He does not make any rational decisions, and I know he will fight me on this. He almost never has any food, and people spend his money when he gets his monthly check. Thank you.

Re: When your elderly parent cannot care for themself

There is a process by which you can become your father's Conservator, aka Gaurdian over assets. It would require your father being declared unfit. Are you and the rest of your family prepared to do this? It will certainly cause animosity if you are unsuccessful, and might even if you are not. You might contact your father's doctor, if he sees one regularly. They may not share any information with you, but may put your concerns into their file, and examine you father for the symptoms you describe.

I am not sure what town you live in, but there competent attorneys all over the state that could assist you in teh many issues that I have not had time to descrive here. If you are near the KC area, let me know, and I will be glad to help you.

Good Luck,

Tony Smith
