Legal Question in Family Law in Kansas

moving child out of state

If a parent has joint custody how can the other plan to move the children out of state even with written consent if the other parent doesn't agree? Days are split up in the divorce papers and there has not been any other judgements or either parent granted sole custody. Is there a way to fight the other parent taking the children out of state without having to file for custody or is that the only option to stop it? It has happened before years ago and it was never fought about, but kids are older now and one doesn't want to go and the other is only 9 years old. Don't know what options are here, but time is limited. Please let me know what can be done....thanks for your time and information.

The only way to stop it is by getting the court involved. You need to file a motion to modify NOW. Please contact me at [email protected]
