Legal Question in Immigration Law in Kansas

My Mongolian girl friend came to U.S. last year legally but has now overstayed her ''work visa'' she is pregnant and we intend to get married soon but her mother recently passed away and now her father has cancer so she needs to go home to be with him, but being here illegally we dont know what the best steps would be, also if she has the child while in Mongolia being half American would that cause any problems or would only my child be allowed back to the U.S.? Any help would be appreciated thank you.

If she has overstayed her visa and goes back, then she will not be allowed back in to the US when she tries to return.

I would advise you to call an immigration attorney to further discuss your options.
