if me and my wife are on a one year lease and we break the lease does my landlord have to take me and my wife to court or just me

Most leases that I've seen allow landlords to go after each tenant individually, or several at once.

You should consult directly with a civil practice attorney, in your area, to see if litigation can be avoided.
