Legal Question in Wills and Trusts in Kansas

what power does the trustee of a trust have (the trust holds all properties in the decedent's estate) who is also the executor of the will and an heir? Do other heirs have any rights if they are not specifically mentioned in the last will?

The powers of a trustee are enumerated in the trust document itself. If one is an heir at law, they can often convince a judge to force the trustee to divulge the contents of the trust documents. The will, once admitted to probate is accessible through the Probate Court. Some heirs have rights to take their lawful share despite what the Will says. If you are involved in such a situation, you need to consult directly with a Probate or Estate attorney as soon as you can. There are time limits on almost anything an heir would want to do.

Good luck
