Legal Question in Workers Comp in Kansas

if someone was injured on their job and received workman's compensation for several months, went back to work doing their regular job, was still dealing with the same injury while working, discussed surgery with their doctor, and has decided to have surgery, can their job prepare to terminate them before a full recovery has been diagnosed? The job has already placed a want ad in the newspaper for the position and they have not even had surgery.

This is a great question to ask the attorney handling the work comp claim. If there is no attorney , it is unlikely that the employee will be able to successfully argue the point, so the employer will probably get away with it.
