Legal Question in Family Law in Kentucky

I am involved in a case where my daughter is the victim of child molestation from her uncle, my brother. My mother is a witness for the defense, can she file for grandparents rights. She lives in Missouri I live in Kentucky. Our trial is not set until July 17th after having to be continued several times. I don't want the 90 day "no contact" issue to come into play. I was advised by the prosecution that it's possibly in the best interest of my child and I not to have contact with any defense witness. Help! I don't want to go through court fighting for rights/custody of my child with my mother.

She can come to Kentucky and file to establish visitation rights - there is nothing stopping her from filing the court action. However, under the scenario you describe she is incredibly unlikely to get very far. You would want to answer the suit, describe the circumstances, and ask the judge for a restraining order or at least keep the action pending until the criminal action is over.
