Spousal Support

My husband and I have been married for 10 years, seperated for nearly 7 years and no children. We both are willing to sign divorce papers, however he wants me to pay for the divorce. Numerous times during our seperation he has needed financial help and I have provided help everytime he has asked. I have a disabled child by a previous mariage and can't work at this time due to his illness. If I file for divorce, do I have the right to ask for maintenance and to have him at least pay half of the divorce? Is there a statute of limitations due to the seperation being such a long time ago? Thank you

You can request that the court award you maintenance and attorney fees. your income and his income as well as other factors will factor into whether a judge will make an award. Please feel free to call or e-mail if you have other questions.
