Hit and Run

My daughter was rear-ended at a stop light by a drunk driver who left the scene and was eventually arrested. The driver has no insurance. My daughter recently had a kidney transplant and could be in danger of losing the kidney because of the accident. 1)Can we sue the driver for anything our insurance doesn't pay for? 2)Can we sue for potential kidney damage or will we have to wait and see what happens? (It may take time to tell if there is any permanent damage).?
