Legal Question in Civil Litigation in Kentucky

Sold A Horse

We Sold a horse with a vet bill of health. The Horse had been at the vet with a growth on her side 2 times I was worried about it being something that needed to come off. The Vet reassured me that it was a wart and nothing to worry about. When the buyer called me I explained about the wart. He proceded to still want her and offered me a down payment. I told him I would hold her until he could come and get her. He showed up on a Friday night 2 days earlier than schduled to pick her up. I showed him the wart and gave him the medication the vet had me use on the growth. he proceeded to go ahead and take her now he is wanting money from me for vet bills due to this growth. I did what I thought was right by taking her to the vet for a check before, he didn't want his own vet to check before buying her. HE paid me in cash and we didn't do a bill of sell, I thought the vet bill of health would do since it was signed over to him on the bill of health. Now he is threating to sue me what are my rights. I did what I thought I was suppose to do.

Thank You,

Re: Sold A Horse

If you disclosed all information about the horse's health and he know's about the veterinarian's diagnosis of the growth on the horse, then the buyer will have to prove there was some other deficiency in this sale. It appears that in your case the key is whether or not all health issues related to this horse were disclosed prior to the sale of the horse.
