Deposit refund??

My daughter went to look at an apartment. It was the weekend so she gave the landlord $525.00 for the deposit. The landlord was going to check ref. on monday and do a background check. She said that she couldn' have the apartment because her last landlord gave a bad ref.when she called old landlord she said she didn't give bad ref. Now the landlord won't give back the deposit, no papers were ever signed. Can she do this??

No, the landlord at issue may not keep monies that do not belong to them period.
