Legal Question in Criminal Law in Louisiana

My boyfriend was charged with theft of a firarm and felon in possesion of a firearm. He was working in a home as a contractor and took a 38 that was lying on a nightstand outside to show to his boss. The maid ran outside and accused him of trying to steal the weapon. Being a convicted felon in the past in Texas he got scared and walked off and tossed the gun in the marsh. He has been out 1 year and did 6 years for spanking a child and leaving one red hand print on his bottom. He is not on probation or parole. His bond was 2000.00 for theft and 5000.00 for the possesion charge. He has a good job and he and I are engaged to be married in the spring. He has a public defender that will meet with him on the day of arraingment. Does he have a better chance of not getting 10 yrs which I am told is the minimum sentence in Louisiana if we hire private counsel? He is only 31 and thinks he is going to jail for 10 yrs no matter what. Do we have a chance at long term supervised probation? This happened in Cameron parish La. and he has never been in trouble in La. I understand the possesion law to read certain felonies of a serious or violent nature.

Since I find it hard to believe that he did 6 years for leaving a red mark on a behind, he may be in more trouble than either you or I really know. It depends on who the public defender is. If what you wrote is exactly correct, then someone needs to speak with the prosecutor, Mr. Cecil Sanner and see what can be done.
