Statute of Limitations on DUI Charge

I was arrested for DUI in Feb of 2003. I went to court twice in 2003 and put in for PTI. I heard nothing back until Oct of 2005. I had a court date in Dec 2005 and although I was supoenaed I was not on the docket and given a new trial date of Feb 2006. I have 2 questions...1) is there a statute of limitations on DUI charges in Louisiana...and 2) Since my arrest the DUI laws have changed...what limits will be used at my trail? Thanks

Re: Statute of Limitations on DUI Charge

First: The applicable law is the law at the time of the offense.

Second: The "Statute of limitations", known in Louisiana as the "Prescriptive period" does run. Its length is determined by the seriousness of the offense. A first offense, as a less serious offense, has a shorter limit than a fourth offense.
