Legal Question in Entertainment Law in Louisiana

Copy Rights & Trademark Law for Music Written

1) I am an American citizen of Louisiana, living and working in the Netherlands for 10 years now

2) I have written some music and would like to take it to a producer / studio to record it

3) How do I secure myself and my songs?

4) Do I have to trademark and or get the copy rights for my songs before allowing a producer to hear and record them?

5) If so, What is the Step by Step process?

I basically want to record my songs without the worry that someone will take my songs and duplicate them because I have no protection. Please advise..

Thank you,

Re: Copy Rights & Trademark Law for Music Written

With regard to your questions, we inform you as follows.

We certainly are able and willing in providing services for you in this matter as your attorney in The Netherlands; moreover, we have experience in handling cases like yours.

Creations of literature, science and art (a.o. songtexts and music) are automatically protected by law, but one of the aspects that should be looked at is the proof that you indeed are the author (copyright owner).

Aside from this, your case has international aspects: you are an American, seeking to protect your rights in a range of countries (amongst which The Netherlands).

This means the Bern Copyright Convention and (or) the Universal Copyright Convention of the Unesco apply.

We would therefore strongly advise you to enter into an agreement with the other party (and lay that down in an adequate contract) before publishing of your work to any other person.

We would be glad to assist you in this respect.

We are looking forward to working with you.

Perhaps you can contact Mr. Marc de Hoogh of our firm:

Please contact me regarding protecting your rights. There are some complications with "conflict of laws" with Louisiana(Civil), U.S. (Common), EU, and law of the Netherlands. I am an entertainment lawyer who can assist you with this dilemma and assist in providing you protection.
