Can i gain custody over my child if the child is now living with his grandparent instead of his mother? We have never been to court and I signed the birth certificate at birth.

You can always petition the court for custody. Whether you will obtain custody of the child will depend on a number of factors, the mother's inability of refusal to take care of the child being a large factor.
