Land Grants

Recently I visited my aunt who gave me a land grant and other documents pertaining to 80 acres of land which my family owned in the 1900's. My great-great grandmother inherited the land from her mother. My great-great grandfather received $600.00 from a man who signed a letter stating the money was a giftand it need not be repaid . Yet, after my grandfather died he had my grandmother (who could not read) served and evicted off of her 80 acres by the sheriff for non-payment of the $600.00 debt incurred by my grandfather. My question is, can my family re-claim the land? We have all the original documents and letters.

The property is undoubtedly quite valuable now, so probably worth your time and money to retain a lawyer who is an expert at real estate and who practices in the county where the land is located, to have her/him review the documents you have as well as the public records at the county recorder's office to see what chance you might have.

However, in all fairness I think your chances are slim due to the five-year statute of limitations on actions to recover possession of real estate. The property has probably passed by adverse possession.......but don't give up just yet, as there may be some fact that negates the adverse possession and the related statute of limitations.
