my brothers are the beneficiary of my mothers 401k plan but she left me a promissory note for $26,000 for payment for her care after a stroke. she stated money was to come from the 401k can I collect on the debt

The proceeds of a 401(K) go to the named beneficiaries, so you can't collect from that.
