Legal Question in Criminal Law in Maryland

Regarding a theft of less than $100.

Hello, I am going to be charged soon with a theft of under $100 ($87.10 to be exact). My statement was only taken by the police officer tonight, so I don't know how long it will take to have charges filed against me by my now ex-employer, if any will be. Anyway, I was wondering what sort of punishment I will face possibly, and whether I should represent myself, get a Public Defender, or hire a high-cost defense lawyer? Please keep in mind that I have never been convicted of anything, even though I was accused and charge of something that was expunged at my court case with no sentence given. Thank you very much. I am very worried about this.

The problem with any criminal case is not so much the penalty, chances of going to jail on a first offense is slim and none, however a conviction will prevent you from getting any type of job involving money or trust. After all, you are a thief. A lawyer can help prevent you from getting that record.

The actual penalty you face depends on whether the employer wants to prosecute you, which judge and which state's attorney you get. Your decision to get a lawyer is an important one, because the maximum sentence you face is 90 days in jail. Because it's your first offense, you will probably not receive that maximum, but if you can't afford a private attorney, I would definitely apply for a public defender.
