Brother's possible penalties

My brother recently recently was charged in Frederick county on Driving on Suspended license and DUI. He has 3 prior (no jail time) DUIs in Mont. Co. Not 100% sure of the outcome of previous charges but know he has not been in jail and was on probation for 3rd arrest when the Frederick Co incident occured. He is completing a 28 day residential rehab program currently. What are the likely outcomes of Frederick Co. case and would he immediately be remanded to Mont. co for violating probation?

Your brother needs a good lawyer who is willing to prepare and go to trial on this one. That is the only way he can get a decent result out of this. He is looking at subsequent offender issues and significant potential and minimum jail sentences. He should be ready to go to trial right away. Asking for a continuance and trying to delay things might inure against him as that might give the state the change to add S.O. papers to the file, if they had neglected to do so already.
