Re: child custody

Until modified, the current custody order remains in force and she must abide by its terms. She cannot file a self-petition with the court to modify custody until she is 16. Until that time, her father would have to seek modification. The preference of the child is one of many factors courts consider when determining custody. It is not a conclusive factor, especially with a child as young as 11.
