distribution of marital assets and depth

am i eligible to receive a monatary settlement on assets spouse has already sold, given away or traded in for new vehicals?

It is not possible to give you a clear legal answer to your inquiry without a more detailed evaluation of the facts of your case. Several questions are presented.

1. Has a divorce proceeding been initiated?

2. When were these assets sold, given away or traded? A long time before the divorce was final? A short time before the divorce was final? After the divorce was final?

3. What did your spouse do with the funds received? Did he/she pay family expenses or debts?

4. Did your spouse violate any court order limiting disposition of marital assets during the pendency of the divorce?

There are a number of factors involved in a determination of whether you can request a court to give you credit for dissipation of marital assets.
