Legal Question in Family Law in Maryland

Hi, I am in the divorce process and we have not worked out child custody arrangements yet. I have three young children, ages 5, 3, and 1. I am the mother. I am wondering about the possibility of moving out of the country and my husband does not want me to take the children. Do I have a legal right to move and take the children or do I have to stay here because of him? What is the likelihood of a court approving my decision to move with the kids? There is no abuse involved.

Moving out of the country would presumably deprive the father of regular contact with the children, so a court is unlikely to go along with this. You need to contact an experienced family law attorney who can assist you in negotiating a marital separation agreement that covers all issues such as custody, support, visitation, alimony if appropriate and division of marital property. If you are able to work these things out before going to court, it will make that process much easier and much less expensive.
