Legal Question in Family Law in Maryland

In early 2010 I was admitted to a hospital due to a diabetic distress. My daughter gave them all my insurance info including Medicare and Medicare Supplement. One of the doctors at the hospital performed an EEG. He billed me and I sent a letter back saying it should be covered by Medicare. Because it's past one year Medicare will not pay and the doctor says its my responsibility. Is this true? He was employed at the hospital and had access to insurance info.

You should have received an Explanation of Benefits from Medicare or your supplementary carrier about this. It would indicate whether you have any responsibility for this bill. If you didn't get that, I suggest you contact Medicare, or your supplementary carrier, about this. If the doctor didn't timely bill Medicare and that is the basis for their refusal, then it's his responsibility. As you pointed out, your insurance/Medicare status would have been readily available to him at the time of the procedure.
