Birth parents are, under the law, presumed to be the best candidates for custody, but in the final analysis, the court must consider what is in the best interests of the child. If your situation is such that neither birth parent can adequately care for the child, and you can demonstrate that you can do so better, you may succeed. But the first thing you should do is consult with an experienced family attorney who can review the specifics of your situation and best advise you on your chances. And the reality is that if you are not represented by an experienced attorney who knows how to prepare and present a custody case, your chances of succeeding are greatly diminished.
