If you were injured as an occupant of the vehicle at the time and incurred medical expenses, even if those expenses were covered by your own insurance, you have a viable claim for bodily injuries that would included pain and suffering. You will maximize the value of your claim by allowing an experienced personal injury attorney such as myself to assist you. If the amount you were offered is clearly only for property damage, you can accept that and pursue your bodily injury claim. Make sure the release specifies that it covers only property damage.

You need to pursue a claim for personal injury. I have experience with these claims and know the insurance companies well. You can accept the property damage payment but you need to be sure that you are not releasing all claims associated with the collision. Call me for a free consultation.
