Legal Question in Real Estate Law in Maryland

We would like an estimate on what it would cost to write up a Contract of Sale/Purchase agreement to purchase 75% property share from two family members at a sell price of $XXXXXX.XX.

Buyer and seller will split closing costs.

Please include any other fees for services that you feel may be required to see the loan through to closing.

No fee is set by law and each firm sets their own fees (either hourly or flat fee). My firm prepares real estate contracts on a flat fee basis. You are welcome to email [email protected] to get a copy of my firm's current fee schedule. Note that with any transfer you may incur various state and county taxes. Transfer and recordation taxes are calculated as a percentage of the transaction price so an attorney needs to know the sale price to estimate those taxes and fees. In Maryland, there are three types of such taxes and the exact percentage varies from county to county. Certain transactions between family members may be exempt from taxation if no money changes hands. There are also more modest filing costs to file a deed and mortgage with the land records (around $95 in court costs)

A few questions that will affect the total cost: 1) Are you obtaining financing from a third party mortgage company or from the selling family members? 2) What county is the property located in? 3) are the core terms already negotiated or do you anticipate present some back-and-forth on pricing and other terms? 4) if you are doing this with a privately held mortgage do you want a title search?
