Lease

We have a lease with the term of 09/01/02 - 12/31/03. Our landlord has the same lease with the dates 09/01/02 - 12/31/02. He says that since by his lease is expired we are now on a month to month basis and he raised the rent by $150 per month. Is he allowed to do this since we do have a signed lease that states it expires in the end of 2003.

In short the lease you have should control. A couple questions for you. Did you receive a notice from him prior to the expiration of the last lease that asked whether or not you planned to renew? Has the landlord signed the current lease that expires at the end of this year? How long have you been tenants in his apartment? Finally, do you have or have you had any disputes with the landlord?

As long as you can show in addition to the lease that it was the intent of both you and the landlord to enter an agreement to lease the apartment for another term, your lease should stand. Please feel free to contact me or any other lawyer of your choice in this matter.
